Personal protective equipment is to be supplied and used at work wherever there are risks to health and safety that cannot be adequately controlled in other ways. INTRODUCTION TO DUTY OF CARE IN HEALTH, SOCIAL CARE 1.1 As a care worker, you have a legal obligation to adopt a ‘duty of care’ approach towards the people within your service. You are required to work in the best interests of the people using the service which includes maintaining their safety and wellbeing. 1.2 It is important to carry out duties that are in own job description and that you are competent. It is also necessary to regularly update own knowledge and skills in order to uphold and provide the care standards that are in accordance with the codes of practice of the care setting. This includes the use of any available resources such as hoists for the moving of residents and ensuring training is up to date by attending all relevant courses.
Activity 12 A] Health and Safety at Work Act (HASAWA) – This act provides the legal framework to promote, stimulate and encourage high standards of health and safety in the workplace. It protects employees and the public from work activities. As an employee I have a duty to comply with HASAWA to ensure my own health and safety and that of others, to cooperate with one’s employer regarding policies and procedures and y not interfering with anything provided in the interest of health and safety. B] Manual Handling Operations regulations (MHOR) – is the movement or support of any load by physical effort which includes lifting, moving, carrying, pushing, pulling and putting down. As an employee I must be aware of and use safe working practices laid down for one’s safety also: * Making proper use of the equipment provided.
I will then go on to look at minimising conflict using a recognised technique and how the adverse effects can be minimised. Causes and Explanation Because there are a variety of personalities within the work place it is inevitable that there will be conflict at some point and this could be for any number of reasons; * Different Personal Values; at some point you may be asked to complete a task that conflicts with your ethical standards. When work conflicts with personal values conflict can arise very quickly and this can be overcome by trying not to ask people to do tasks that you know will cause them distress due to their beliefs/values. * Unpredictable Policies: When rules or policies change within the workplace and those changes are not communicated clearly, confusion and conflict can occur. It is essential to inform people of changes and why these changes are happening as when you are aware of why something is being altered you are much more likely to accept it.
To do this I should keep my training up to date, follow all policies and procedures set by employer in order to keep things safe. If I see something that is wrong my duty of care would be to report what I see happen i.e. whistle blowing. Also if I am told to do something I don’t feel comfortable doing or something not in my job description make sure I decline doing it as it’s my duty of care to only carry out duties I feel competent doing. Be aware of dilemmas that may arise about Duty of Care and the support available for addressing them 2.1 Describe dilemmas that may arise between the Duty of Care and an individual’s right You may have a case as a care worker where an individual may want to do something which could be a risk to their own health and safety.
1.2 The employers have a responsibility to make sure correct PPE is made available, organise the necessary training for staff and undertake risk assessments regarding infection control. The employers must inform staff of infection control policies and procedures and make sure they are provided with the necessary information to follow safe practices when working such as a COSHH file, risk assessments and information posters. 2.1 Most of the legal regulations relating to infection control come under the Health and Safety at work act. This act is about ensuring a safe work place for employers, employees and members of the public by minimising accidents and infection spreading at work.
