Adverse impact is the general impact of employer practices that creates a considerably different rate of selection in promotion, hiring and other decisions which work to the disadvantage of affiliates of a certain sex, race or ethnic group. For example, if an applicant feels they are a victim of inadvertent discrimination due to an employer’s interview process because the company requires a Masters degree, the company would in turn have to prove that a degree is essential to one’s performance for that job. Title VII litigation use the 80% rule as a basis for determining if companies have an adverse impact on a protected group. DeStefano, a group of city firefighters in New Haven, Connecticut claimed that the city discriminated against them in consideration of promotions. This group of firefighters, nineteen of which are white and one Hispanic, all met the requirements of a test for promotions into managerial roles. The city overthrew the test stating that they were worried a lawsuit might happen due to the fact that none of the black firefighters achieved high enough test scores to be considered for a promotion. The twenty firefighters that passed made a claim they had been refused for promotions because of their race. After several hearings and test certifications a decision was reached that the test did not create an adverse impact and were accurate assessments of firefighter’s qualifications as related to the job. However, due to the fact that the employer tried to overthrow the test results in order to avoid adverse impact they were held liable for an attempt to avoid claims of adverse impact. New Haven reinstated the test results and 14 of the firefighters who passed the exam received promotions. Although adverse impact was not proven in this case, if IOS had not created/certified a test that decreased adverse impact to the protected class this could have resulted in adverse impact
