The Family and Medical Leave Act (FMLA) protect workers by providing reassurance that their job is safe and they will be able to return to work under the same pay rate and position after returning from medical leave. If you or a parent, child or spouse becomes incapacitated due to a serious illness or other health condition, the FMLA allows you the option to take the needed time off from work to care for your loved ones. In situation A since the spouse of employee A has given birth prematurely to twins, this unexpected event is something that would be covered under FMLA since Employee A's spouse and child need care, meets the criteria for leave. The ADA also states that reasonable accommodation is required so that an individual can perform essential job functions. The Act also states that a company doesn't have to provide accommodations if the accommodation creates undue hardship for the employer. If the company has more than 15 employees, which Company X clearly has considering it has a headquarters with 7 floors and an elevator; they are legally required to adhere to the ADA rules. In situation C, Applicant C is bound to a wheelchair, but otherwise qualified to perform all essential job functions that are required of him. Company X is discriminating Applicant C and is in clear violation of the Americans with Disabilities Act in it's claim that Lowering the keypad in 2 elevator cars would cause undue hardship as a financial burden on the company. There are a few clear examples to show why Applicant C could bring a lawsuit and win based on this violation. First, assuming Applicant C can perform all job functions asked of him and would otherwise be hired, there are 4 elevators and only 2 of them need a modification to accommodate a wheelchair bound employee.
