LAW 421 WEEK 2 Individual Assignment University Of Phoenix WEEK 2 INDIVDUAL ASSIGNMENT NAME: DATE: LAW 421 INSTRUCTOR: Once I finished participating in the simulation I began to see many problems when it came to the practices and the resolving of international transaction disputes. I took some resourcefulness to navigate through difficulties of working with two separate sets of protective laws. One of the major problems I encountered was that you are forming one agreement for two different companies, each with their own set of government policies regarding business. Each of the two parties involved should do their part to protect against legal disputes, for instance drafting a choice-of-law clause. This action is a good start, so that both parties define and protect specific laws.
According to Manoski (2002, p. 1), “R&D strategy is both an input to and an outcome of the business strategy. In its preliminary state it provides a key basis for the identification, evaluation and selection of business opportunities and therefore, a set of options for the direction of a business.” Riordan presently uses a research and development strategy; however, with some fine-tuning, the organization could discover trends beyond its current domestic and China focus by expanding into other international areas. By expanding its horizons, Riordan may discover other needs the organization is not meeting or ways for improving existing products. The latter part of this strategy provides the framework necessary for execution of this strategy in alignment with the differentiation
Acquire or Develop Talent Tanglewood should acquire talent, because it wants to keep performance and customer service at high levels. In addition, while old stores under Tanglewood have the same basic look, the management styles and human resource can use some improvements. Acquire talent is very helpful for new stores, because employees would “hit the ground running” and be at the peak performance the moment they arrive. Hire Yourself or Outsource Personally, I think Tanglewood should hire itself. Outsourcing is more practical for small and medium companies.

To help set the high standards for myself I can speak to the manager to discuss what the standards are for the company and what I am required to do to implement this. I can also review pass work to gain a further understanding and feel for what standards are expected for employees of the company.
International Legal and Ethical Issues Keith Shaheen LAW 421 January 17, 2013 Simone Tyler International Legal and Ethical Issues Setting up a contract between Cadmex Pharma; in the United States and Gentura in the country of Candore; must be mutually beneficial for both companies. The contract should protect the rights of a company against any disagreements or disputes. American business in foreign countries will need to consider the different cultures, customs, ethical differences, international laws, and political situations when negotiating any contracts. Such incentives could include employee of the month and small gifts for top customer services. When setting up such incentives it is important to get the employees input on what would help to motivate them in keeping up customer service and sales. Employees also want to know you are making investment in them. By having regular trainings to keep employees up on the menu, safety regulations, and customer service the employer is showing there invested. Trainings should also be fun and not nuisance for the employee to complete.
Hiringthe foreign workers may interfere with the policies of China¶s political and legal environment.Prior to Riordan¶s plans to expand the facility in Hangzhou and hire additional foreignworkers, the management should consider the political and legal climates of China to eliminateinterference with the goals of the company. China is a communist state but embraces a freemarket economy (Hodgetts, Luthans, & Doh, 2005). Presently the political environment is stablein comparison to Latin America or the Middle East (Hodgetts, Luthans, & Doh, 2005). However,Riordan needs to investigate thoroughly the legal and regulatory aspects of expanding the facilityand hiring foreign workers in China. The legal and regulatory environment in China needs investigating. Planning to expandthe Hangzhou facility must be approved by the government.
In other words, one-child policy is another way to reduce the resources. Chinese government encourages people “late marriage, late childbirth”, which make a big effect for young couples’ thoughts. In today’s China, some young couples choose to have children late or do not want to have a child. Some new styles of family are growing in China. For a big country like China, one important thing is being responsible to the world.
Very importantly, workers should be better protected from employer intimidation when attempting to organize unions. Businesses need to take employees seriously and understand that although it will cost more to pay a union income, it benefits the employees’ welfare and may improve their individual performance. Mass transit should also be improved. It will help economically and environmentally. And finally, employment insurance should be extended as well.
The fact that Wal-Mart is a company not even a country; and is China’s eighth largest trading partner; just makes us realize how much economic growth depends on businesses to produce more goods and services faster and more efficiently. According to many economists, continuous economic growth leads to greater prosperity for everyone, but because so many countries are trying to achieve the same exact thing, competition is harsh. These are some positive and negative perspectives that are caused by international trade. As you can see, the relationship between the three sources is that they are all based on trade. All around the world, different countries import and export goods to each other so they can benefit themselves with economic growth.
